The Florida PIP Law is set to expire on October 1st, but legislators may be breathing extra life into this law by calling a special session. Though PIP applies to Automobiles, not our motorcycles, it's still an important topic for us as most of us still depend on our four wheel transportation. So, What happens to your insurance if PIP expires? Ken Worrow an Allstate offers his expertise...
When there is NO Florida No Fault Law: (Our no fault law applied to Automobiles, not our motorcycles) By law, PIP coverage pays the following benefits, up to the $10,000 limit:
- 80 percent of reasonable and medically necessary medical expenses;
- 60 percent of disability benefits for lost gross income and earning capacity;
- 100 percent of replacement services (such as child care, housekeeping, etc.);
- and $5,000 per individual death benefit.
Our no fault law will Sunset in October. Automobile policies that renew after October 1 will no longer be required to include Personal Injury Protection. That means that if you are injured in an automobile accident PIP (personal injury protection) will not pay anything for your care because there will be NO PIP coverage. Who will pay? There are several places that the money can come from. You may have optional Medical payments coverage on your automobile policy or you may have health insurance. If another driver caused your injuries, you may decide to sue that person. If the other person has no insurance, you may decide to sue your own insurance company under Uninsured/Underinsured Motorist coverage. When an accident is your fault you are responsible for the cost. If you have insurance, submit the bills to your insurance company for payment. If you don’t have insurance, get your checkbook out. It’s important now to contact your agent or me and make sure you understand what you are covered for or not covered for. Make the changes now so you are protected in the future.
